We succeeded in an Appeal against a refused Planning Application and Conservation Area Consent Application for the demolition of a garage and proposed two storey side extension incorporating a double garage and a granny flat.
This was a challenging appeal; the LPA refused the application for three reasons. The first was the impact of the loss of an important gap to the Wandsworth Common Conservation Area. The Council also decided that the design was out of character and would harm the appearance of the Conservation Area. The third reason provided was the impact on the living conditions of adjoining properties with particular reference to outlook.
Collaborating with the Architect (Michael Evans) and the client we successfully demonstrated to the Planning Inspectorate that the gap did not make a significant contribution to the character of the Conservation Area and that such infill development has occurred in the locality without harm to the Conservation Area. We also established that the design intention was to preserve and enhance the streetscape and that the Council’s criticism on the design was subjective. Furthermore, The Planning Inspectorate agreed with our case that the separation distances were adequate, so there would be no harmful effect on outlook.
